Patents
A patent provides legal protection for an invention which may include "any new and useful process, machine, manufacture, or composition of matter, or any new and useful improvement thereof." In order to be patentable, the invention must be both new and non-obvious from all previously existing processes, machines, articles of manufacture, or compositions of matter. When patented, a patent owner may prevent others from making, using, or selling an infringing item.

A trademark ™ provides legal protection for a word, phrase, symbol, design, or a combination of these things that identifies a source for goods or services. Use of trademarks provides customers with something they may recognize being from a particular source or brand in the marketplace that distinguishes goods and services from those of a competitor.

A copyright © provides legal protection for written works, movies, plays, music, lyrics, recordings, photographs, sculptures, and artworks. A copyright is provided to a work on its creation once it is recorded into a tangible medium. No action is required to obtain this right, registration of a copyrighted work is required in order to enforce a copyright against an infringer. The registration provides constructive notice to all potential infringers that the work is protected. Infringement that occurs after a registration is obtained may be entitled to enhanced statutory damages.

A trade secret is valuable company facts and information that is kept confidential to prevent competitors from copying products that are unique to the business. Famous examples of long held trade secrets include the formula for Coco-Cola® or the KFC® chicken herbs and spices recipe. These secrets may be protected by law from disclosure and use if they are treated properly by their owner. Suits can be used to keep the secret private or to collect damages for misuse of the information.
